For all members of scans_daily: the community has been suspended for posting copyrighted material without the permission of copyright holders, which is against LiveJournal's ToS. Before you ask:

1) At this time we don't know who made the complaint. But guys, we don't want this to turn into a witch hunt.

2) No, we don't have backups, but we're looking into recovering our entries. ETA: pandanoai made a backup early this month. You'll need this to view it. acroamatica has it mirrored here.

3) skalja set up a backup comm on insanejournal some time ago. If you're in dire need of scans, go here for now. ETA: A while ago, sir_razorback set up a message board for the comm here. comics_scans is another scan comm on eljay. Their rules and culture are a bit different from ours. If you join, be sure to read the userinfo before posting. stubbleupdate has set up noscans_daily. Please join, so we can keep our community together.

4) No, this will not be the end of us. Vive les scans!

5) ETA: Since people are asking about eljay's stance on fair use, from the TOS:

LiveJournal and its designates shall have the right, but not the obligation, to remove any content that violates the TOS or is otherwise objectionable, or that infringes or is alleged to infringe intellectual property rights. I will say this exactly once since misinformation is already abounding

1) A link to the scans site was put up on Comic Book Resources. I clicked on it and saw what I believed to be a violation of Marvel's copyright. I read none of the comments at the time; instead I gave Marvel a heads up. I was later told that before Marvel even had an opportunity to take action, the scans had already been taken down.

2) I later replied to some posters. I didn't have a problem with their criticism of my work. The work is the work; if they're customers, they have a right to criticize. Actually, they have that right even if they're not; they're just uninformed. However, I did state that I thought postings that were nothing more than profanities written in large type and desires that I "die in a fire" were inappropriate and, frankly, threatening. (Having had a friend die in a fire, I couldn't comprehend how anyone could wish that on someone.) I was later told that "die in a fire" wasn't a threat. Right. Send a letter to Barack Obama telling him you want him to die in a fire and you'll find the Secret Service at your door and your name on the no-fly list. Yes, the profanity-shouting threatening poster then put up a more detailed critique and I stated I wasn't interested in reading it because of her personal attacks. If someone hurled obscenities and invective at you...would YOU be interested in hearing what they subsequently had to say?

3) I have no idea why Scans itself was shut down. I didn't have the power to do it, nor the influence, nor frankly the interest.

4) Boycott my work or don't; it's entirely up to you. If you hated it and were looking for an excuse to drop it, then this is probably it. If you were enjoying it and are doing it just out of...I don't know...spite, well, okay. Your choice. It's too bad that you can no longer enjoy the work simply because of your opinions of the creator.

From one mod out of three

First of all, just so you know, after getting your wife's PM we've made a few mod posts in the appropriate places asking that people stop sending you rude e-mail. I can't promise that it'll all stop, since I'm not anyone's mother and it's more than possible that there are trolls mixed in with the disgruntled scans_daily members harassing you, but I do hope it helps.

I'm sure you had no intention of getting scans_daily shut down, although I do think your actions played a role. You informed Marvel, of that there's no question. The X-Factor scans disappeared due to some kind of Photobucket activity even before Marvel could do anything, but my best guess is that even after the X-Factor scans were taken down, Marvel assumed from your descriptions that we were a hotbed of piracy and complained to LJ. LJ decided that enough was enough and shut us down without recourse. Alternatively, Marvel thought, "Whoa, we knew about this site but didn't realize it was that bad - we should take a closer look," and started browsing around, then complained straight to LJ without talking to us - same result.

Frankly I think there's plenty of blame to be scattered around - honestly, I think if we the mod team had been more on the ball and put our new rules out quicker, relocated sooner, or tried a number of other options, this might not have happened, at least not so soon. Or if Marvel were more forward thinking about the nature of internet media, or Livejournal's abuse team not so knee-jerk ... if, if, if.

I don't know if you'll accept an apology from a moderator rather than an involved party, but I really am sorry for the "DIAF" incident, and that applies regardless of the suspension. The other mods and I were actually discussing both how to mend fences personally and trying to hash out the new rules, which included stricter guidelines on behavior towards non-members and creators.

However, my condolences about your friend, but I don't think "Die in a fire!" is a threat. The best comparison I can think of is that it's more a hail of imprecations or a curse. The internet's version of "rot in hell," if you will. Does that mean it's a nice thing to say? Hell, no. I think it was a rude thing to say, I wish I'd had my act more together to moderate that post - again, that sentiment stands regardless of what happened yesterday - and in your place I wouldn't have felt any desire to continue the conversation, either. But I hope explaining what DIAF means to most people helps you understand why so many people are going, "Dude! It's just DIAF! What's he freaking out over?!" To many people it's a rude but entirely symbolic turn of phrase.

I do think your getting in touch with Marvel was the straw that broke the camel's back, PAD, but it was probably a geriatric camel anyway. I'm not going to pretend to be thrilled, but what's done is done.

What about ONTD? They post magazine scans all the time. No one's messing with them.

In fairness, it's been my impression that they post fewer pages (percentage-wise). I don't know what, specifically, they do to avoid getting TOS'ed, though.

I appreciate the kind words, everyone, and I meant what I said.

But those people saying hideous things about what should be done to Peter David are hurting your cause. I know the mods have graciously and ethically done their best to avoid bile being steered anyone's way, and I respect them tremendously for that.

Let's follow their example, please. This toxic stuff makes the community look bad unfairly. This is a real human being, not Snidely Whiplash.

Thank you. I know I'm speaking to a TINY minority and that they're riled right now. But I think even they will wake up and regret saying some of the crazy stuff I've been seeing aimed at Mr. David.

Oh, sigh. this sucks I went to go check Wonderella's blog today and I saw the title was "Sans Daily" I felt my heart drop to my shoes and quickly popped over to my LJ to see for myself that my beloved (though I haven't posted in quite awhile) s_d was gone.
It is sad; because s_d is the force that REALLY, (underline 'really' three times) got me into the comics fever and even consoled me after the first issue of that wretched Xena comic. I am glad to know what happened, and I would like to thank the_dark_cat whom I just discovered today for the link here.
Therefore, with that said, I do not count s_d as out, the old Queen (drag?) has some life in her yet. Moreover, even if she is gone we will always have our memories and maybe a really awesome Irish styled Wake. =)

What hurts the most out of all this is that it hurts the indie comics who rely on the word-to-mouth (er scan to eye) that fans give each other for their books because the indie publishers can't afford to rely on Diamond to do it for them.

I also miss the snark and the old books I can't find or can't afford. :( We'll get ya back scans_daily!

I could be wrong, but it seemed like scans_daily did more to promote the comics industry than most any other place online and made all sorts of fans where there were none before. What a shame it was taken away.
